Common Interest Communities/Homeowners Associations

Colorado Mediation Center, LLC is available to provide dispute resolution services for your Homeowners Association or other Common Interest Community Association.

As of January 1, 2007, pursuant to recent amendments to the Colorado Common Interest Ownership Act, (CRS §38-33.3-124), most common interest community associations are required to adopt a written policy setting forth procedures for addressing disputes arising between the Association and unit owners. The statute also encourages common interest communities to "adopt protocols that make use of mediation or arbitration as alternatives to, or preconditions upon, the filing of a complaint between a unit owner and association in situations that do not involve an imminent threat to the peace, health or safety of the community."

Please contact Colorado Mediation Center, LLC for assistance in drafting, reviewing, or revising your policy. Click here for a Sample Policy and Guide for Use of the Sample Policy.

This Sample Policy and Guide were developed by a subcommittee of the Colorado Council of Mediators HOA Outreach/Education Project.  Beth Brown Ornstein of Colorado Mediation Center, LLC was a member of this subcommittee.
